What is dominant land?

Dominant land is the parcel of property that has an easement over another piece of property. The type of easement involved is almost always an appurtenant easement. Likewise, it is almost always an affirmative easement, that is, one that permits a person to do something. A dominant estate is also called a Dominant tenement.

To establish if your property is dominant over another, you must check your title register and title deeds for a reference to any easements. If you have an easement over anothers land, you have a dominant plot.

It is worth noting dominant and serviant tenements can be held for one title (piece of land).
